In a nutshell...burglar is stabbed and dies....householder is arrested for MURDER!

WTF - murder is pre meditated/planned/you go out and get someone...not protecting your house and possibly your own life and kill the bastard criminal who was trying to rob you...

This country is messed up - if that man goes down for this then shame on those who send him down.

It obviously depends on the circumstances but in the case mentioned (and the vast majority) I think he should be given a bloody medal. Just imagine you wake and hear someone in your house. You really don't know what you'd do in those circumstances. I think we should be allowed to protect our families and our possessions.
Scumbag burglar deserves what he got.

That bloke was only protecting his home and family. If the burgler didn't burgle then he wouldn't be dead right now. Unfortunatly the police won't class it as "reasonable force"

When I lived in a shared house a girl came in my room to rob my stuff and I, of course, got rather upset it turned into us having a biatch fight and ME almost getting arrested!!! I said to the officer "errrm excuse me officer SHE was the one robbing me arrest her" and then she lunged for me so we started fighting again and the officer said we're both getting arrested for afray!!! Unless we both drop charges on each other!

So, she got away scot free cuz I didn't want to get arrested and have affray and other things like assault on my records. I even told the officer it was a bloody shambles (& nearly got arrested again for not being quiet lol)

So moral of the story is:- keep your big gob shut & if someone wants to rob you, let them or it'll be YOU getting arrested.... xxxx

If someone comes into your home to rob you then I think they deserve everything they get. If more people were like this man maybe burglars would thing twice about going into someones home and stealing.

I think it's ridiculous too BUt I can also see why the law isn't changed... if you were a murderer or even just wanted to kill one person then you could say they had broken in to your house so you killed them...

Obviously I don't think that would happen often but you know... lol if they openly say it's ok that's probably what would happen.

However, if anyone came into my house i wouldn't just sit there and let them i'd defend myself and if they died as a result of that then so be it.

He has been released on bail and they are saying that things are changing with regard to the law.

There was a case a few months ago where something similar happened and the home owner was let off without charge.

He hasnt been charged yet and I really dont think he will be.

I would have done the same in his situation x

I'll be devils advocate
he still killed someone, did he have to go to that extreme, he still took a life, I know he was protecting himself and his home, but that's still someone's son no matter what he did.

But I do agree law needs to be changed like those suffering domestic abuse and then had enough and fight back with consequences, I don't think they should be charged with murder, but also don't think a pat on the back is right too

Ok I dont think he should be done for murder, but mansalughter possibly. There's not really enough facts there to judge properly eg was the householder being physically attacked.

Id disagree with a law being passed to say if someone enter's your home you can do what you like to them without consequence.

I work with young males aged 14-17 and some of them engage in criminal activity. They make poor choices, dont understand (or care I suppose) about consequences, havent been taught to feel guilt or compassion towards others. They still on the whole can be good kids who need help and support. Id hate to think of one of the kids I know robbing a house and being stabbed to death because of it. People can change their behaviours and I dont advocate killing 18 year old kids who are mixed up in things like this.

Yes its terrible that people get burgled but I really dont think giving people the green light to kill intruders is a good idea. I know thats perhaps not what you are proposing but the law has to be clear cut. Iv saw how quickly some young adults spiral out of control, and not all are from appalling backgrounds. Id hate for my son to be killed in a situation like that. I think its up to the courts to punish burglars not members of the public.

Its very easy to say they deserve what they get, but when its a family member or someone you know the background of you may feel differently.

I agree snoopy I think it's a really hard thing to call and like I said if it comes down to it, its one persons word that the "intruder" was burgling them... they coulda actually been some random stranger invited in off the street for the purpose of killing someone lol

I think you should be able to use reasonable force to protect yourself but if someone had broken in to my house I dont know if Id rather let them steal stuff than try and stop them... unless of course they were in Tylers room and then Id prob just go mental and attack them, but I doubt id be strong enough to kill them maybe knock em out. I suppose if I accidentally killed them thats a whole ofther kettle of fish though!

Good point about just inviting someone into your home to kill.

Obviously I would do what I had to to protect Caitlin from physical harm, but tbh if I heard creeper burglars nabbing the tv or lifting my car keys from the hall id prob just lie there and shit myself rather than confront them! Things can be replaced.

If I killed someone, even while defending my home, Id find it very hard to live with. Id still have taken a life, and it would really affect me emotionally thinking about the persons family, the if's, why's and buts etc. Id hate to ever be in that position. At the end of the day having to justify to yourself why you killed someone to protect your car, TV and laptop to me wouldnt be easy eh?

I am really hard one this one.

If somebody enters your home to rob, damage or cause any form of intimidation, then in my opinion, if they know the law (if it got changed), then they do it at their own risk.

I wouldnt just go stabbing somebody for the fun of it, but if somebody was in my house, I couldnt lay there either not knowing if they were creeping into my kids bedroom, or even taking my children in their sleep. How would you really know if you didnt get up and see for yourself.

We have a baseball bat under our bed and I wouldnt hesitate to use it and kill anybody that went within 10 feet of my kids in my own home.

The biggest shame is that people are faced with this decision in their own homes, and thats just wrong. x

I don't know if they ever would change the law so that it specifically states what is and isn't acceptable in these circumstances (and they probably wouldn't know where to start with writing that!)

Its not fair that people should be worried to defend themself in their own homes but then of course if you say that's ok to do then you risk people claiming self defence when it wasn't... *shrug* it's a hard one to call and I think normal people just need to trust or hope that the law will protect them if it ever happens to them :/

Yeah I agree Jade.

There is always the worry that it could open up all sorts of circumstances where people entice people into their homes to stab them and blame it on burglary, and if the law was changed then people would twist it to their advantage.

I do think that there needs to be some sort of 'beyond reasonable doubt' that the homeowner/occupier was, or felt, threatened, if that makes sense. x
