Hi Girls

I was just wondering if anyone had any experience of personal injury claims. I was in a minor RTA in July and injured my back. I have been to see a consultant who states that the injury will resolve itself in time. I have also suffered alot with anxiety/panic in the car since the accident. I used to love driving but am now so jumpy I hate driving. I am so jumpy as a passenger too now and it is causing alot of stress each day.

My solicitor has asked if I am still experiencing anxiety issues in the car which I am and if so to let him now as they will refer me for another report. I am just concerned as I have come of all my meds including my anxiety medication in the last few weeks as we are ttc. I am worried that this will go against me and am wondering if it is worth the extra stress.

I hate the thought of claiming but I was injured and am suffering psychological effects but don't want people thinking of me as a sponger/money grabber, does this sound mad?

The only thing I hate about people claiming is when there is blatantly nothing wrong and they just see it as a way of making a quick buck! If you're still suffering then there is a reason for you to claim. I don't know much about it though sorry, just wanted to say I don't think you're a money grabbing sponger Very Happy Very Happy

Has a claim been put in, and an offer made yet?

As a result of the consultant's report (which should include physical and emotional injuries) + your statement and details of any other losses - you should have been made an offer.

It's then for you to decide if you want to take it further - it is always advisable to turn down the first offer anyway but a lot of people will accept to have it done with.

If you reject the offer you'll more than likely be offered a higher sum - but usually as a result of another medical report, looking at your records in greater detail (you may have already signed a disclaimer for them to access your medical records - check with solicitor? If not it might happen after turning down 1st offer).

Have you had treatment - physio, accupuncture etc.? If not and you feel you would benefit, see your GP for referral then get back on to solicitor - who should push to have it done privately (and quicker) being paid for by the other side.

Basically, I'd weigh things up as and when you have an offer made. The distress and anxiety caused should all be detailed in your statement, and could be added in another letter to give an up to date picture too (for them to take into account when quanifying compensation).
