Is it fair really? _
PostSubject: Is it fair really?   Is it fair really? EmptyFri Mar 25, 2011 5:02 am

this is something that really bugs me - i work in a care setting and if we are ill with certain things we are not allowed in the workplace - fair enough its to protect the service users.... butttt... they dont pay you if you are off?!
I luckily havent been in this position yet but i rely on every penny i earn, and if i was ill i couldnt afford to take the time off work so i would more then likely just not tell anybody about being ill.... i literally cannot afford to lose a single shift at all, i'm pretty screwed this month because i had to come home early one day cos i vommed a few times .... so if they tell you when you can, and cannot work, shouldn't they pay you if you can't work fo the service users safety?

well tbh if you are willing to go in work when your sick, but you cant for the sake of the service users, then yes id say you should get paid!!
i work in the hossy and we cannot go in when we are ill, but the amount of times iv dragged myself in feeling like poo because we are made to feel guilty or get as disciplinary or overtime ban Mad!! luckily i wasnt working on wards during them times, but i know someone who didnt dare ring in sick(she relies on her overtime) and went in, working on the meternity unit with flu...and passed it on to us lot too, i was heavily pg at the time(oops sorry mini rant of mine there Embarassed )
but yes i think you should get paid xx

I know you're entitled to statutory sick pay if you're I'll for 4 days or more, but some employers don't pay out for like the first day to discourage pisstakers. I think it's a disgrace you don't get anything but if that's what's in your contract you're stuck with it Sad

Do you work every day/night?

TBH I would think yes you should get paid if you are willing to work as it isnt your fault if they wont let you work... However surely a more sensible solution would be if you dont work every night/day if you say did mon, tue, wed could you maybe do mon, tue, thurs if you were poorly on the weds? that way your not missing a shift?

As Em says SSP is not paid on the first few days, so if you are sick for 2 or 3 days you get nothing unless you have extra sick pay in your contract, and even when you get SSP its only about £60 a full week!

I haven't worked anywhere that has been just SSP for a very long time (if ever?) but some have had the one day rule which I found stupid - they say if you are ill for more than one day they will pay but if just one day they wont - so yeh everyone who just had a 24 hour bug ended up off more than they actually needed to be!
Whereas the places that pay full pay regardless you could be really ill, have 1 day off then feel up to work and go in - no problem!

Ive always worked in an office environment and although the bosses sometimes made you feel bad for being off (usually when low staff due to sickness and hols!) BUT it was never as bad as dragging yourself in with a really bad bug, and then everyone in your office catching it!!!

As for the original post - yes I think its shite - if you want to work they should find something for you to do that isnt in contact with other people, i bet its possible!

yes its in the contract - we dont get paid for the first week off and after that it would be ssp.
I dont work everynight wriggs, i just do two a week, but its a rota so if you were on the monday and you were ill then unless somebody else rang in sick aother day theres not a chance to do another day.
say if i was ill for two weeks, then i would be down £200, which is my food shopping money for the month!

The company I work for is the same. If you dont work you dont get paid. But your situation is difficult as willing to go to work when you are ill you should be paid, BUT it's a care setting so you'd be passing on an illness maybe to people who may already been unwell or likely to pick up an illness more quickly.

SSP is unpaid for the first 3 days, it's £79.15 a week.

in that case you need to pull them up cos their contract is contravening your rights - you are entitled to SSP (which they dont pay - its public funds!) on the 4th day of sickness

http://www.direct.gov.uk/en/MoneyTaxAndBenefits/BenefitsTaxCreditsAndOtherSupport/Illorinjured/DG_10018786

Also they cant say its cos you dont work every day 'you're sick for at least four days in a row (including weekends and bank holidays and days that you do not normally work)'

if they still refuse to pay SSP according to the law then you should contact CAB!
