Ok the house i live in now is owned by Bens sister. I rent it from her. The house i am moving to at the weekend is Bens nieces house and i will be renting it from her.
I put a housing benefit claim in on the 17th Jan for this house and today i have put a claim in for the other house.

A decision hasnt been made on the benefit for this house due to the fact i am renting from family. There will be the same problem with the new house.

I have served my notice in this house as of next week and have signed the tenancy for the new house. But the problem is if they decide i cannot get housing benefit because its family i am f%^&ed.

They have told me today not to move at the weekend as if i dont get HB i will be liable for rent. They said i should stay here and if i dont get HB i should make my sil take me to court to evict me. But i would still be liable for rent here!!! They said i will be making myself voluntary homeless if i move and dont get HB!!!

They said i could end up in a B&B miles from here!!!!!

I could get another house thats not family and they would pay rent no problem but the new house has been totally renovated for us and is within the same area for the kids friends and school.

And i absolutely CANNOT stay in this house due to the circumstances.

I honestly could cry right now, it just gets worse and worse. I feel like giving up!!!!!!!

How long as the lady owned the house for, surely they cant think she bought it 'for' you and you are trying to get HB to pay the mortgage?!

do they def know you renting from family?

what a tie to be in, if you cannot stay in the house your in, if you could get a letter stating this from an authority, or anyone, then that should help you, however making yourself intentionally homeless is not good because that means they can stop you claiming housing benefits.

is there a 28 day back out in the new tenancy agreement, so you can look for something else.

how about putting a council housing claim in too and also all the housing associations in the area, get sil to write you an intent to evict and this will push you up the housing ladder.

i'm sorry hun but do any of the kids have special needs, if so use this to help with keeping them at that school would school write a support letter for you too.

or how about they pay the housing benefit into your bank and then you pay landlord, not sure how its done but i know it can be.

sorry hun i'm probably rambling but i'm trying to think on my feet, if i had a family at work in this situation of needing to move and HB being an issue, i'd be writing support letters and get schools and health to assist, soemtimes it helps sometimes its a waste of time.

I'm sorry that you're going through even more shit. I you go homeless wouldn't they make it a priority to re home you (maybe a council house) as you have 4 kids! Do the hb people know that you could end up homeless?

Well the house i am in now sil has owned for about 20 years, but the new house they havent owned very long, the have just rushed through the renovations for me. But they do have other houses they rent out.

The housing benefit know the situation but dont seem very bothered or interested.

As you and Ben have split up, and its his neice who owns the house, I would say that there would be a fine line between actually it being owned by 'family', so if they dont have it on record, dont tell them.

if its owned outright there should be no chance of this being the case anyway.

Bens sister own this house outright as far as i know, but Angie has only just bought that house to rent out, but before this happened so not for me. They have 4 other houses they rent out too so its not as if its a one off xx

thats what am wondering, if they own this house putright too, should go for you, also having a property portfolio should go in your favour surely to frikken god!

To be fair they still probably wouldnt be happy as they may worry that mara's getting cheaper rent from family and they are paying too much to her. It really is a bollox. Im so sorry you going through this crap mara! x

The thing is i am only asking them to pay £350 per month, so its not like i am trying to swindle loads of money out of them x

As i said before i know numerous girls who's parents have bought a house when they got pregnant to rent out to them using housing benefit. Housing benefit knows it's their parents they're renting off and it was never an issue at all, so i think you should be able to get it hun, fingers crossed!

If not could you find some other privately rented accomodation that they will pay housing benefit for?
